Terms & Conditions
1. General Provisions
The following Terms and Conditions (hereinafter referred to as “T&Cs”) apply to all assignments granted to the photographer. They are deemed accepted unless promptly objected to in writing within three business days. Diverging terms and conditions of the client shall not apply unless expressly confirmed in writing by the photographer.
The term “photographic work” refers to all products created by the photographer, regardless of form or medium (e.g. digital files, USB stick, hard drive, online gallery, prints, etc.).
2. Copyright & Usage Rights
All copyrights remain with the photographer and/or videographer.
The images created are intended solely for private, personal use unless otherwise agreed in writing.
Usage rights granted by the photographer are, unless expressly stated otherwise, non-exclusive and non-transferable. Commercial use and redistribution are not permitted without prior written agreement.
The client has no right to reproduce or distribute the images unless explicitly granted. When images are used online or in print for private purposes, the photographer must be credited as the author. Failure to do so entitles the photographer to claim damages.
RAW files remain the sole property of the photographer and are not provided to the client.
The photographer is entitled to use images showing the clients (and no guests) for self-promotion (e.g. website, social media, exhibitions, trade fairs, blogs, photography or wedding magazines). Privacy is treated with the utmost respect. Clients are welcome to express any concerns – these will, of course, be honored. However, please note that a working portfolio is essential for this business.
Other vendors (e.g. makeup artists, decorators, planners, etc.) may only use images after obtaining the photographer’s explicit permission.
3. Fees & Retention of Title
The fee for photographic services is agreed as an hourly rate, daily rate, or flat fee. Additional expenses (e.g. travel, props, studio rental) are to be covered by the client unless otherwise agreed.
Cost estimates provided by the photographer are non-binding. Should any additional costs arise during production, they will be communicated. If the scheduled production time is exceeded due to reasons beyond the photographer’s control, an additional fee will apply based on the agreed rate or a reasonable surcharge.
A non-refundable deposit of 20% is due upon booking.
Invoices are due within 7 days of receipt without deduction. The client is considered in default 30 days after receipt unless otherwise stated. The photographer may issue a reminder earlier.
All delivered works remain the property of the photographer until full payment has been received.
4. Liability
The photographer is liable only for intent and gross negligence, except in cases involving injury to life, body, or health, or breach of essential contractual obligations.
Liability for damage to props, templates, files, layouts, or data is also limited to cases of intent or gross negligence.
The photographer stores data carefully but is entitled to delete them three years after completion of the assignment.
No guarantee is made for the longevity or colorfastness of photographic products beyond the manufacturer's warranty.
5. Disruption of Performance / Cancellation Fee
If the client cancels the agreed service, the photographer is entitled to compensation for financial loss. This includes the non-refundable deposit and, within one month of the wedding date, 75% of the base fee (excluding travel and accommodation costs).
If the photographer is unable to fulfill the assignment due to illness or another reason for which they are responsible, the deposit will be refunded. The client's statutory right of withdrawal remains unaffected.
6. Data Protection
Personal data required for business transactions may be stored. The photographer treats all information received during the assignment as confidential.
7. Image Editing
The photographer selects the final images. The client has no claim to receive all photographs taken.
The client is familiar with the photographer’s style and agrees to image editing in that same artistic style. Specific requests must be discussed and confirmed separately.
Subsequent editing, duplication, or distribution of the delivered images – including converting to black and white or sepia, altering colors, or creating collages – is not permitted unless expressly agreed upon in writing.
Any online use of the photographer’s images must ensure the photographer is clearly credited as the creator.
8. Delivery Times & Complaints
Standard delivery time is approximately 4 business weeks. For wedding coverage, delivery may take 8–10 weeks.
Delays during peak season (May–October), technical issues, or force majeure do not justify complaints.
The photographer is liable for missed deadlines only in cases of gross negligence or intent.
All work is carried out with the greatest care and to the best of the photographer’s ability.
Obvious defects must be reported in writing within 14 days of delivery and accompanied by the affected product.
Reprints may differ in color tone from the originals and are not grounds for complaint.
If digital images are printed independently by the client, the photographer assumes no responsibility for the quality or durability of the results.
For guaranteed color-accurate prints, orders must be placed through the photographer.
9. Final Provisions
For all matters not covered by these terms, statutory regulations apply.
The place of jurisdiction is the registered office of the photographer.
10. Severability Clause
Should any provision of these Terms and Conditions be or become invalid, the remaining provisions shall remain unaffected. The invalid clause shall be replaced by the applicable legal regulation.
